Car crash, need advice?

a month ago some pratt decided to go straight through a junction without looking. he went straight into the front/side of my car and didnt want to go through insurance straight from the start. i have witnesses to say that it was totally not my fault and photos of the damage on both vehicles. the only thing is the other party hasnt got insurance for the van he was driving. the van is insured through a company but not for him, the company says they leant him the van out the goodness of there heart. also the company whos van it is havent reported the crash to there insurers as they say it is nothing to do with them. am i correct in thinking that the companies van insurance have to pay out. my insurance is third party, fire and theft, the crash was no fault of my own and my car is a total loss. any info on what happens next would be great. kind regards and thankyou in advance.
